THE ENGAGEMENT

 

Initial Consultation

Consultants at Legal Resource Group, LLC develop close working relationships with clients.  Potential conflicts are explored and eliminated during the initial consultation.  A complete history discussion with a potential client gives the consultant the "big picture."  Specific guidance is solicited and goals of the investigation are identified.  If an engagement is anticipated through a law firm, the attorney will contact the client and obtain consent to hire and pay our company.

Once the hiring is approved by the client, an engagement letter is prepared outlining the investigation, fees, etc.  Critical in the engagement letter process is the inclusion of definitive language that extends the attorney-client privilege to Legal Resource Group, LLC and it's consultants when working directly for an attorney or law firm.

Meeting with Clients

We find that face-to-face meetings with clients are productive.  The process gives the client assurance that their best interests are of utmost importance to the consultants being hired.  It also gives the consultants the opportunity to develop a professional, working relationship with the clients.  Specific, detailed, and important information often is gained through initial and follow-up client meetings.  Of course, the meetings are confidential and covered by the attorney-client privilege if our firm is "engaged" by the law firm.

Examining Available Books and Records

After the initial meeting with clients, consultants look at documentation already available and in the hands of the client and attorney.  Additional documents needed are identified and a preliminary list of witnesses is prepared.  Subpoenas are issued to record custodians who need extended times to produce records, such as banking institutions, brokerage firms and similar institutions.  Records are categorized and labeled to facilitate future retrieval.

Supporting schedules are prepared as records are analyzed. Examples of the type of schedules that might be used are:

  • Checking/Savings Account Analysis of Checks and Deposits (Check and Deposit Spreads)
  • Brokerage account analysis
  • Loan histories, including proceed distributions and re-payment.
  • Link Analysis

Identification and Interviewing of Witnesses

Witnesses are prioritized and interviewed.  The method of recording the interviews is determined by witness importance, with guidance from the attorney.  Two consultants interview the most important witnesses.  Tape recordings of critical interviews are transcribed through our Transcription Service office.  Certified transcripts of the conversations are provided for an additional fee.  Most interviews are recorded by memorandum for use later in the investigation and at deposition.

Reports of Investigation

As the investigation progresses, the consultant keeps the client up to date through memorandums, witness interviews and summaries of activity undertaken.  When the goals are reached, consultants finalize a detailed and fully exhibited Report of Investigation, including a list of witnesses and exhibits.  If requested, the report will include conclusions and recommendations.

Trial Preparation

Consultants assist in trial preparation at the request of the engaging attorney.  Assistance includes preparation of trial books, locating witnesses, dealing with uncooperative witnesses, and similiar activities at the request of counsel.

Testifying at Trial

Consultants are available to testify as fact, summary or expert (Financial Fraud) witnesses.
